By using our website or subscribing to our services, you agree to these Terms of Use. If you do not agree, please do not use our services. These terms apply to Fyxo AI ("we," "us") and you, the client ("you," "client").
We provide AI-powered customer support automation, configuring an AI agent trained on your business information to respond to customer messages across email, WhatsApp, SMS, and/or voice channels, depending on your selected plan.
Our AI is designed to handle common, repetitive support queries accurately, based on the information and rules you provide. However:
Subscription fees are billed monthly (or annually, if selected) in the currency shown at checkout. Third-party messaging fees — including Meta/WhatsApp per-message charges and telecom charges — are payable by the client directly to the respective provider and are not included in subscription fees unless expressly stated in the plan. See our separate Refund & Cancellation Policy for billing, cancellation, and refund terms.
We aim for high uptime but do not guarantee uninterrupted service, as our platform depends on third-party infrastructure (AI providers, messaging platforms, hosting). We maintain backup providers for critical systems to minimize disruption, and will notify you of any significant outage affecting your service.
You retain all rights to your business content, branding, and customer data. We retain rights to our underlying automation systems, templates, and software. Nothing in these terms transfers ownership of our platform or methodology to you.
We treat your business information and customer data as confidential and will not share it outside the service providers necessary to deliver our service (see our Privacy Policy) without your consent, except where required by law.
To the maximum extent permitted by law, Fyxo AI shall not be liable for indirect, incidental, or consequential damages arising from use of our service, including but not limited to lost profits or lost customer relationships resulting from AI-generated responses. Our total liability for any claim shall not exceed the fees paid by you in the [1–3] months preceding the claim.
Either party may terminate this agreement per the terms in our Refund & Cancellation Policy. We reserve the right to suspend or terminate service immediately in cases of non-payment, misuse of the service, or violation of these terms.
These terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of the courts of Puttaparthi.
We may update these terms from time to time. Continued use of our services after changes constitutes acceptance of the revised terms.
